The second mortgage or home equity loan becomes discharged and the balance owed is canceled out.  Just last week my office successfully wiped out a second mortgage for a client in the amount of $158,000. This case involved my Chapter 13 client's ability to reduce the balance owed on her second mortgage of her duplex house. I tried to reduce the balance my client owed on her second mortgage significantly, from $87,000 to about $6,000. Her mortgage company objected, and the Rhode Island bankruptcy court ruled in my favor. The mortgage company appealed the decision to the Bankruptcy Appellate Court in Boston. We submitted briefs to the Court in December, and just recently the Court affirmed the decision of the Rhode Island Bankruptcy Court, resulting in my client being take more than $80,000 of of her second mortgage balance. The best part of the Plan is that my clients will only have to pay back the $49,000 at 5.5% interest. At the end of five years, they will own their house free and clear, due to the cramdown provision in the Bankruptcy Code.
